Terms of Service

1. Acceptance of Terms

By engaging Malta SEO Pro ("the Company," "we," "us," or "our") for any services, you ("the Client") agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you should not use our services. These terms constitute a legally binding agreement between you and Malta SEO Pro, registered at 14 East Street, Valletta VLT 1211, Malta.

2. Services Description

Malta SEO Pro provides the following digital marketing services:

• Search Engine Optimization (SEO) including on-page, off-page, technical, and local SEO
• Web design and development
• Digital marketing consulting and strategy
• Pay-per-click (PPC) advertising management
• Social media marketing and management
• Content creation and content marketing

The specific scope of services for each engagement will be outlined in a separate proposal or service agreement provided to the Client prior to commencement of work.

3. Payment Terms

All services are invoiced monthly in EUR (Euro) unless otherwise agreed in writing. Payment is due within 14 days of the invoice date. Late payments may incur interest at a rate of 8% per annum above the European Central Bank base rate, in accordance with Maltese law.

We reserve the right to suspend services if invoices remain unpaid for more than 30 days. Any third-party costs (such as advertising spend, domain registrations, or hosting fees) are billed separately and are the responsibility of the Client.

4. Client Responsibilities

To enable us to deliver our services effectively, the Client agrees to:

• Provide timely access to website hosting, CMS, analytics platforms, and any other tools required for the engagement
• Provide timely feedback on deliverables, strategies, and content within agreed timeframes
• Supply accurate and up-to-date information about their business, products, and services
• Ensure that all materials provided to us (text, images, logos) do not infringe on any third-party intellectual property rights
• Designate a primary point of contact for communication and approvals

5. Intellectual Property

Upon full payment for services rendered, the Client retains ownership of all deliverables created specifically for them, including website designs, content, and graphic assets. Malta SEO Pro retains ownership of all proprietary methodologies, tools, frameworks, templates, and processes used in the delivery of services.

We reserve the right to showcase completed work in our portfolio and case studies unless the Client explicitly requests otherwise in writing.

6. No Guarantee of Rankings

While we employ industry best practices and proven strategies to improve our clients' search engine visibility, Malta SEO Pro does not and cannot guarantee specific search engine rankings, traffic volumes, or conversion rates. Search engine algorithms are controlled by third parties (such as Google) and are subject to change without notice.

Any projections, estimates, or forecasts provided are based on our professional experience and available data but should not be construed as guarantees of specific outcomes.

7. Limitation of Liability

To the maximum extent permitted by Maltese law, Malta SEO Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with our services.

Our total liability for any claim arising from our services shall not exceed the total fees paid by the Client to Malta SEO Pro in the 12 months preceding the claim.

8. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information disclosed during the engagement. This includes business strategies, analytics data, customer information, and trade secrets. This obligation survives the termination of the agreement.

9. Termination

Either party may terminate the service agreement by providing 30 days written notice. Upon termination, the Client is responsible for payment of all services rendered up to the termination date. Any prepaid fees for services not yet delivered will be refunded on a pro-rata basis.

We reserve the right to terminate services immediately if the Client breaches these terms, engages in illegal activity, or fails to make payment for more than 60 days.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the Laws of Malta. Any disputes arising from or relating to these terms or our services shall be subject to the exclusive jurisdiction of the courts of Malta.

11. Changes to These Terms

Malta SEO Pro reserves the right to update these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after any changes constitutes acceptance of the revised terms.
